1990 RESOLUTION 9-90 CREATING WHITEHALL TV RESOLUTION 9-90 CREATING THE "WHITEHALL PUBLIC TELEVISION DISTRICT" WHEREAS, the Jefferson County Board of Commissioners received a petition requesting the organization, formation and creation of a television district; and WHEREAS, the boundaries of the television district and the lands to be included in the proposed district, are set forth in Exhibit "A" attached hereto; and WHEREAS, out of the 1329 registered electors, Clerk and Recorders in Jefferson, Madison, and Silver Bow counties validated 719 signatures, constituting at least 51% of the registered electors who are residents of the proposed district as set forth in 7-13-2503, M. C.A. ; and WHEREAS, the objects of the television district are: a) to bring Public Broadcasting System television services to all residents within the boundaries of the district; b) to provide such Public Broadcasting System television services under a system of taxation which would fairly allocate the costs thereof to all users within the district; and, c) to eliminate the expense and difficulty of making individual collections from users within the district by placing each share of the expenses of operation on the assessment list of each user, so as to provide for collection of the same as part of the annual collection of property taxes; and WHEREAS, a brief description of the system is as follows: a) a concrete pad will be constructed, which will be used • for the location and operation of a dish-type antenna for receiving television transmissions from stationary satellites; b) a transmitter building will be constructed; c) a transmission antenna will be constructed; presently, the contemplated location for said antenna is the Blue Water Tower within the Town of Whitehall; d) certain of the equipment will be housed in the old Cheese Factory at 309 East Legion in the Town of Whitehall; and, e) the total construction cost for the antennas, transmitters, buildings and equipment will be approximately $123, 715.00; in addition, there will be a hookup fee of $3, 750.00 which will be paid to . Rural Television Systems. All of the property and equipment of the district will be insured against loss at full value; and WHEREAS, it is presently anticipated that taxes levied by the television district shall not exceed $20.00 per household per year, $12.00 of which would pay operating costs and $8. 00 of which would be applied toward the costs of construction; and WHEREAS, the petition was duly noticed for public hearing in the "Whitehall Ledger" and "Madisonian" papers as required by law; and WHEREAS, the Board convened the hearing on January 2, 1990, and thereafter continued and completed the hearing on January 30, 1990; and at such hearing the Board heard comments from proponents, opponents and interested persons wanting to be heard on the proposed television district. NOW, THEREFORE, the Jefferson County Board of Commissioners HEREBY FINDS that creation of the proposed district is conducive to the public interest and convenience for those persons residing in the district because it will provide, at reasonable cost, public educational television services not presently available from any other source. Such educational services will provide access to programming beneficial to children and/or supplementing and enhancing public school curriculums. The Board FURTHER FINDS that the proposed public television district will provide the contemplated services in the most convenient, practical and economical manner possible under the circumstances. Absent creation of the district, the residents thereof will have no other convenient, practical or economical way to obtain such services. NOW, THEREFORE, BE IT RESOLVED that the said district, having the above described boundaries, objects and purposes, construction, and cost shall be created and shall be named the "Whitehall Television District, " and an appropriate order creating such district shall be hereinafter entered pursuant to this resolution. Copies of such order shall be filed with Clerk and Recorders in Jefferson, Madison and Silver Bow counties; further, a copy of the order shall be filled with the Secretary of State. BE IT FURTHER RESOLVED that the district acting through its Board of Trustees, appointed as provided by law, shall possess and perform all powers and duties set forth in Title 7 , Chapter 13, Part 25 , M.C.A.
