MONTANA 59632 ANNUAL LEVY AND PUBLIC MEETING DEAR JOANNE McFARLANE AND GENTLEMEN: THIS IS AN EXTREMELY IMPORTANT LETTER: Attached is a copy of the letter from Freeman Jensen, President of the Basin County Water and Sewer District, dated May 1, 197$. This letter sets out the procedures to be followed pursuant to the request of the Board of Directors for a tax levy on property within the District for 1979. The Board of Directors of the Distrfict has determined that rum= once again the sum of $13,000.00 must be obtained through taxation for the forthcoming fiscal year. Sinc rely ,y- r/ cc: Mr. Freeman Jensen Allen J!M*J5: — form MT5.N73 The Drowing Board,Inc.,Box 505,Dallas.Texos May 1, 1978 • Jefferson County Board of County Commissioners Jefferson County Courthouse Boulder, Montana 59632 RE: Annual Levy for Basin County Water And/Or Sewer District Gentlemen: Pursuant to the provisions of Section 16-4527 R.C..M. , 1947, as amended, the Board of Trustees of the above-named District have determined that revenues of the District from water and sewer charges will be inadequate to pay the interest or princi- pal of its bonded debt as it becomes due and to establish reasonable reserve funds for payment of principal and interest on the bonded debt. Accordingly, the Board has determined that it will need to receive taxes through the Basin County Water And/Or Sewer District Bond Tax for the forthcoming fiscal year in the total sum of $13,000.00. The Board of Directors of this District hereby request the Board of County Commissioners for Jefferson County, Montana, to levy an amount of taxes for the forthcoming year in an amount which will produce that sum in tax revenue for the benefit of the District. The lands benefited by this levy will be those lands included within the boundaries of the Basin County Water And/Or Sewer District and the Basin Fire District which will appear of record in the Office of the Jefferson County Assessor and which are more particularly described as the exterior boundary lines of Sections 17 and 18 of Township 6 North, Range 5 West, P.M.M. The Board of Directors of this District has agreed to accept, for this year, the County Commissioners previous determination Jefferson County Board of County Commissioners May 1, 197$ Page 2 that the assessment against the land to be assessed shall be based upon the taxable valuation, as stated in the last completed County Assessment Roll, of the lots or parcels of land, exclusive of improvements thereon, within said District, and that each lot or parcel of land to be assessed shall be assessed with that part of the amount of money required which its taxable valuation bears to the total taxable valuation of all of the lands to be assessed. Your duties in connection with this request are outlined in Section 16-4527 R.C.M. as amended through 1977. These pro- visions require that you hold a hearing each year on the question. Notice of the hearing must be given as follows: 1. By posting notice thereof in five (5) public places within the county and within the boundaries of the lands upon which the taxes to be levied, and 2. By publishing a copy of the notice once each week for two (2) consecutive weeks in a newspaper published in the county wherein the District is located. 3. By forwarding regular first class mail or registered mail, at least ten (10) days prior to the hearing, a copy of the notice addressed to the owners of taxable real property within the District as shown by the current assessment book on file in the Office of the Assessor. In the past this notice has been given as required by Items 1 and 2 above but Item 3 has not been complied with and as a resutt, , tax revenues are jeopardized. In fact, there was a tax protest by the railroad last year which resulted in the loss of considerable revenue to the District because the notice was not mailed to the owners of taxable real property within the District.
