MISC: 1949 STREET LIGHTING FOR COURTHOUSE MISC: 1949 STREET LIGHTING FOR COURTHOUSE STREET LIGHTING CONTRACT BETWEEN THE MONTANA .POWER COMPANY AND JEFFERSON COUNTY IN THE STATE 07 MONTANA. THIS CONTRACT, Made and entered into this f r day of 14C,007Xrq 1949. by and between THE MONTANA POWER COMPANY, a corporation having its prin- cipal office and place of business at East Broadway, Butte, Montana (herein after called the "Power Company"), and the COUNTY 0? JEFFEl SON, in the State of Montana (hereinafter called the "County"), WIl'NESS 'H: 'ail Pats, the County has requested the Power Company to install a modern and sufficient street lighting system in the streets surrounding the County Courthouse, and to own, maintain and operate said system, and the Power Company is willing to do so upon the terms herein contained: NOW THEIEFORE, in consideration of the premises and of the mutual cove- nants and agreements herein specified to be kept and performed by the parties hereto, it is agreed as follows: 1. INSTALLATION OF SYSTEM: The Power Company undertakes and agrees to construct and install in the streets in Jefferson County, Montana, a street lighting system consisting of five (5) G,000 lumen lights fed bylustcr- ground conductors. The glass fixtures will be the standard qestinghouse AK 10 type or equivalent. Locations, type of equipment and number of lights may be modified only by mutual consent of the parties hereto. Said lighting system shall be installed as soon as reasonably possible, taking into con- sideration material shortages, and shallt at all times be the property of the Power Company. 2. MINTLVANC3 AND OPYIR&TIONI The Power Company agrees to furnish, maintain, operate and supply electricity to said street lighting system for the charges hereafter specified. Lights shall be turned on at dusk and turned. off at dawn each day during the term of this agreement. The Power Company shall have no duty or obligation to patrol said lighting system to see that all of said lights are in operating condition at all times, but will make necessary repairs and replace lamps and glassware within a reason- able time after notice of any outage. Cam: The County undertakes and agrees to pay the Power Company for furnishing, operating anti maintaining said street lighting system and for delivering electric energy thereto as follows: Unit Charge Total Charge No. of Lights Lumens Watts type Per Month Per Month 5 6000 370 Glass Enclosed $ 2.57 ', 12485 Underground Cable 3.00 The charge for electric ener ;y included in the above monthly charges • is based upon Rate Schedule SL-147P. Lamp wattages are in accordance with the maaufacturers' 1947 ratings and changes in efficiency will not be reflected in the electric energy costs unless manufacturers' ratings show a change in wattage of five per cent (5%) or more. The charges above shown are based upon estimated normal wear and breakage for lamps, glassware and posts. It is within the police power of the County to prevent wanton and malicious damage to street lights. In consequence thereof, the Power Company shall have the right to make an additional charge to the County at the actual cost of material and labor for repairs and replacements made necessary by the acts of third parties. If the number of lighting units shall hereafter be increased upon the mutual agreement of the County and the Power Company, the above charges per month per light shall apply to additional units of the same style and size. Bills for service hereunder shall be due and payable in cash or valid warrants at the office of the Power Company in Helena, hontena, when rendered each month, and will become delinquent ten (10) days there- after. If any bill remains delinquent for more than twenty (20) days, the Power Company may discontinue service without further notice. !}, INTERRJPTION:3 OF SRhVICE: It is understood and agreed that the Power Company shall not be liable for failure to comply with any of the terms and conditions of this agreement where such failure is caused by acts of Cod, governmental regulations or orders, strikes or labor difficulties, fires, flood, droughts, riots, destruction of property, or, without being limited by the foregoing, by any other cause beyond the reasonable control of the Power Company. Page 2 5. TERM: This agreement shall be and. remain in full force and effect for a period of two (2) years and eleven (11) months from the date hereof, and shall thereafter continue in force and effect from year to year until and unless terminated by either party giving to the other party notice in writing at least sixty (60) days prior to the expiration of the initial term hereof or any annual extension thereof of its in- tention to terminate this agreement. IN WITNNa3 WHMEOF, the parties hereto have ceased this agreement to be executed in duplicate by their respective officers thereunto duly authorized, the day and year first above written.
