RESOLUTION WHEREAS , the Board of County Commissioners of Jefferson County, Montana in conjunction with the City of Boulder, Montana, has approved and authorized the establishment of a joint City-County Planning Board within Jefferson County, MOntana, in accordance with provisions of law; and WHEREAS , numerous community improvement projects including public water systems, public sewer systems and street pavement projects are underway or contemplated within Jefferson County in both incorporated and unincorporated cities and towns, and it appearing that projects of this nature qualify for federal grant funds upon certain conditions being complied with as required by federal rules and regulations; AND WHEREAS, one of the requirements made by federal agencies granting funds for community improvements within Jefferson County is that the City-County Planning Board have initiated, or completed, a comprehensive county-wide survey and that the technical work required by such survey be preformed by a qualified engineering firm; AND WHEREAS, the engineering firm of Morrison-,Mairle, Helena, Montana, has entered into an agreement with the City-County Planning Board to the effect that they will conduct county-wide survey and that the charge therefor will be 59, 500.00; and the Farmers Home Adminis- tration of the U. S. Department of Agriculture having agreed to provide grant funds against said cost of engineering survey in the amount of $6,000.00 provided the balance of $3 , 500.00 is made available through a tax levy; AND , WHEREAS, the preparation of this comprehensive area and for Jefferson County, MOntana, is deemed to be of great beneficial interest to all communities within Jefferson County as more particularly out- lined in the resolution of this Board establishing and creating the joint City-County Planning Board; NOW, THEREFORE, BE IT RESOLVED that the Board of County Com- missioners of Jefferson County, MOntana in consideration of the fore- going, and in accordance with provisions of law, does hereby agree to provide for the payment of the sum of $1,750.00 annually for the next two years by means of a tax levy for the Joint City-County Planning Board, which funds shall be expended for engineering services required by the county-wide comprehensive area survey plan which is to be prepared by the engineering firm of Morrison-Mairle of Helena, Montana. AND, WHEREAS , the Board of County Commissioners under authority of the 1965 amendment of Title 11 , Chapter 38 , RCM 1947 , and speci- -1- fically Section 11-3830.1, may request the City-County Planning Board to conduct specific planning projects within the county and outside the jurisdictional area of City-County Planning Board; and NOW, THEREFORE, the Board of County Commissioners desires to have the City-County Planning Board undertake the preparation of a Comprehensive Area Plan for the orderly development of water and sewer systems in the rural communities of Jefferson County; and WHEREAS , it is expressly desired that this Comprehensive Area Plan will encompass the rural areas of Jefferson County, Montana, with specific reference to the unincorporated communities of Basin, Clancy, Alhambra and the incorporated towns of Boulder and Whitehall; NOW, THEREFORE , BE IT RESOLVED that the Board of County Com- missioners hereby request the Boulder - Jefferson City-County Planning Board to undertake the preparation of a Com- prehensive Area Plan for the orderly development If water and sewer systems in the rural communities of Jefferson County outside the jurisdictional area of said City-County Planning Board; and WHEREAS , in furtherance of such decision for the need of the preparation of a Comprehensive Area Plan, it is hereby decreed that the City-County Planning Board be authorized to execute all necessary agreements , reports, and other instruments in connection with the receiving of a grant as may be required by the Farmers Home Adminis- tration; and said Comprehensive Area Plan for water and sewer systems is to be prepared in accordance with the guides furnished by the Farmers Home Administration, and the covenants of the Grant Agreement; END, it is further authorized that the City-County Planning Board is authorized to accept, receive, and expend funds in the form of a grant to be received from the United States of America, acting through the Farmers Home Administration, United States Department of Agriculture ; and NOW, THEREFORE, BE IT FURTHER 8ESOLVED that the Board of County Commissioners of Jefferson County, Montana, in consideration of the foregoing, and in accordance with the provisions of the law as set forth above, does hereby ratify and approve the formation of the City- County Planning Board, the request for a Comprehensive Area Plan, execution of documents in connection therewith, and acceptance and payment of such grant funds and services from the Federal Government by the Boulder - Jefferson City-County Planning Board, and directs said planning board to accept grant funds and deposit the same with the city or county in a special non-reverting planning board fund to be available for expenditure by the planning board for the purpose designated by the Farmers Home Administration, that withdrawals or disbursements of said funds shall be subject to the approval of the County Supervisor or other designated representative of the Farmers Home Administration and evidenced by warrants or vouchers in the manner required by law. Adoption of development district. (1) Adoption by tht planning and zoning commission of the development district or any change therein may be in whole or in part but must be by the affirmative vote of the majority of the whole commission, provided, however, that prior to an) such adoption, a public hearing shall have been held not less than 15 days after notice thereof shall have been posted in at least three public plaee6 within the area affected. (2) The resolution adopting the district or any part or parts covering one or more of the functional elements which may be included within the distrir; shall refer expressly to the maps, charts, and descriptive matters forming the pattern or part thereof. The board of county commissioners shall have the power to authorize such variance from the recommendations of the planning commission as will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the decision of the planning and zoning commission will result in unnecessary hardship. The planning and zoning commission may, for the benefit and welfare of the county, prepare and submit to the board of county commissioners drafts of resolutions for the purpose of carrying out the development districts or and part thereof previously adopted by the commission, including zoning and land use regulations, the making of official maps, and the preservation of the integrity thereof and including procedure for appeals from decisions made under the authority of such regulations and regulations for the conservation of the natural resources of the county. The planning and zoning commission hereby is empowered to authorize and provide for the issuance of permits 3 a prerequisite to construction, alteration, or enlargement of any building of structure otherwise subject to the provisions of this part and may establish and collect reasonable fees therefor. This petition is necessary in the interests of the public in order to insure the orderly development of said Section 2 , T. 5 N. , R. 4 W. , P.M.M. , Jefferson County, Montana, and to promote the health, safety, and welfare of the general public. /9 PS ,‘. 11S.-1 40I-C"IF RESOLUTION NO. 14 - 96 A RESOLUTION PROVIDING FOR REORGANIZATION OF THE JEFFERSON COUNTY PLANNING BOARD WHEREAS, the passage of Senate Bill No. 377 in the 1995 Session of the Montana Legislature requires and allows the Board of County Commissioners to reorganize administrative boards, districts and commissions pursuant to §7-1-201, MCA; WHEREAS, on April 4, 1972, the Board of County Commissioners created by resolution a County Planning Board; and WHEREAS, the Board of County Commissioners has determined it is appropriate and desirable to provide the Planning Board with clarification as to the organization membership, terms, authority, rules and responsibilities of the Planning Department, setting forth the same pursuant to §7-1-201, MCA and §76-1-101 through 76-1-113 MCA. NOW, THEREFORE, BE IT RESOLVED as follows: 1) Pursuant to 76-1-501 , the jurisdictional area of the Jefferson County Planning Board shall be all of Jefferson County but not including the areas within the incorporated city limits of Whitehall and Boulder. 2) That the Planning Board shall consist of nine (9) members: one (1 ) member of the governing board of the Jefferson County Conservation District and (8) members to be selected from throughout the County to reflect as equal a representation geographically and by population density as is possible. Where areas of rapid development can be identified, greater representation may be drawn from those areas. Pursuant to 76-1-212, all members of the county planning board shall be resident freeholders in the area of jurisdiction. One member of the Jefferson County Commission shall serve as an ex officio, non-voting member of the Planning Board. 3) The terms of the Planning Board members shall commence on the first day of February. The members shall serve staggered two (2) year terms on the Board so that no more than five (5) terms expire in any given year, except that the County Commissioner's term length shall be at the discretion of the Board of County Commissioners. Pursuant to this resolution, members appointed in 1996 will be appointed for one or two years of service in order to establish this staggered pattern. 4) Pursuant to 76-1-212 (2), all citizen appointees on the Planning Board shall serve at the discretion of the County Commissioners and may be removed by a majority vote of the County Commissioners. 5) The Planning Board shall set a regularly scheduled monthly meeting day and time and shall meet at least once in the months of January, April, July and October pursuant to 76-1-301 MCA. If there is no business to come before the Board, the chair may cancel the regularly scheduled meeting with at least forty- eight (48) hours public notice, if possible. Additional meetings may be scheduled with at least (48) hours public notice. 6) Board members shall be entitled to mileage and expenses in accordance with established state rates for attendance at Board meetings and conducting official Board business. 7) Pursuant to §76-1-302, MCA, the Planning Board shall elect from its members a president(here-in referred to as chairman) and a vice-president(here-in referred to as vice-chairman). A majority of members shall constitute a quorum. The Planning Board may adopt by-laws to this resolution so long as they do not conflict with county policies and procedures. 8) Pursuant to 76-1-305, the Planning Board shall have the power and duty to: (a) exercise general supervision of and make regulations for the administration of the affairs of the board; (b) prescribe uniform rules pertaining to investigations and hearings; (c) keep an accurate and complete record of all departmental proceedings, record and file all bonds and contracts, and assume responsibility for the custody and preservation of all papers and documents of the board; (d) make recommendations and an annual report to any governing bodies represented on the board concerning the operation of the board and the status of planning within its jurisdiction; (e) prepare, publish, and distribute reports, proposed ordinances and proposed resolutions, and other material relating to the activities authorized under Chapter 76, MCA. 9) Board decisions concerning the following actions shall not take effect until approved by the Board of Commissioners: a) the determination of wages and salaries to be paid to employees of the Planning Board; b) the acquisition by lease, purchase, or otherwise, and the disposition by lease, purchase or otherwise, of real property by the Planning Board, or operation of equipment in excess of $2,500.00, not previously approved in the budget process; c) entrance into interlocal government agreements or contracts for servicing and financing. 10) Pursuant to 76-1-306, the Planning Board may hire a planner, a board secretary, an examining surveyor and such other employees or contract for such other services as required for the discharge of the duties and responsibilities listed above. The Planning Board shall be responsible for the supervision of its staff and, at its discretion, may designate certain of its staff to supervise others on the staff. The County Commissioners reserve authority to hear appeals and/or overturn any decisions. 11) Planning Board employees shall be subject to all personnel policies as adopted by the County Commission. Additional policies may be adopted by the Planning Board specific to its operation, provided they do not conflict with those in effect for the entire County. 12) The Planning Board shall be responsible for the preparation and administration of a budget for the Planning Board and Planning Department but no budget shall be considered final unless it has been adopted by the Board of Commissioners after public hearing and an annual budget adoption pursuant to 1 e Title 7, part 6, §2301, et seq. 13) The Planning Board shall provide to the Board of County Commissioners a register of membership with addresses, and phone numbers, including a designation of officers, and dates, times and places of regularly scheduled meetings. The chair shall assure that, no less than forty-eight (48) hours prior to each meeting, an agenda is posted at each designated public posting place within the County. (See Jefferson County Resolution 57-95.) Minutes of each meeting shall be filed with the Clerk and Recorder. 14) All purchases of equipment or services or sales of equipment or services by the Jefferson County Planning Board in excess of S 100.00 shall be by competitive bid.
