Culverts will be uced at all drainage crossings with drop structures installed in the dra Lnage below the road and with riprap on the upstream side to a height equal to the top of the culvert. Culverts will lie on-grade with the present streaa channel. 5. The road should be surfaced with gravel and will be properly mintained to prevent erosion. 6. Grantee shall install a minlmm 14-foot cattleguard in the road at a point 91 feet south of the E 1/16 comer of the SE4 of Section 19. Cattleguard and wooden base &hall be to the specifications shown on the attached drawing. 7. This right-of-way say be renewed. Box 588 Right-o£-Way MTM25413 Boulder, Montana 59632 Right-of-Way Amended Name Chancre Recocmized By decisions dated July 31, 1975, the Jefferson County Sheriff was granted right-of-way (R/W) MTM25413 for the operation and maintenance of a communication facility on public lands near Boulder. The grant was issued under the authority of the Act of March 4, 1911, and was amended September 29, 1976, to allow additional equipment for emergency medical services. The grant was renewed on June 24, 1985, under the authority of Title v of the Federal Land Policy and Management Act of 1976. New regulations for communication sites were published in the Federal Register on November 13, 1995. These regulations allow building owners to sublease space and they also establish a rental schedule. The county sheriff's department recently requested the authority to sublease space during Realty Specialist Susie Williams' phone conversation with Tim Campbell. Maintenance on the access road to this site was the responsibility of the U.S. Forest Service until their reservation was relinquished on October 31, 1996. Therefore, all present users are being required to assume the road maintenance responsibilities. It has also been determined that Jefferson County is the proper entity to hold this grant, rather than the county sheriff, since other county services also utilize the building. Therefore, the subject grant is hereby amended to include the following stipulations: 1. The holder is hereby changed from Jefferson County Sheriff to Jefferson County. 2. The holder shall maintain the access road, shown on the attached Exhibit A, in a safe, usable condition, as directed by the Authorized Officer. A regular maintenance program may include, but is not limited to, blading, ditching, culvert VIII — installation, and surfacing. Rediscover Your Public Lands 2 3 . The holder is authorized to rent space and provide other services to customers and/or tenants and must charge each customer/tenant a reasonable rental, without discrimination, for the use and occupancy of the facilities and services provided. The holder must impose no unreasonable restrictions nor any restriction restraining competition or trade practices. By October 15 of each year, the holder must provide the Authorized Officer with a certified statement listing all tenants and customers, by category of use, located within the facility as of September 30 of that year. 4 . When requested by the Authorized Officer, the holder must furnish technical information concerning the equipment located on the property. This decision may be appealed to the Interior Board of Land Appeals, Office of the Secretary, in accordance with the regulations contained in 43 CFR, Part 4, and the enclosed Form 1842-1. If an appeal is taken, your notice of appeal must be filed in this office (at the above address) within 30 days from receipt of this decision.
