I For valuable consideration, Grantor grants and conveys to Grantee and its agents and assigns a temporary construction easement and a no -exclusive perpetual public utility easement across real property owned by Grantor and located ii Section 3, Township 1 North, Range 4 West, P.M.M., Jefferson County, Montana. The ea�ements are for the purpose of laying and maintaining a sewer main and associated infrastructure to provide sewage and wastewater collection to the residents of Amalgamated Sugar Company Subdivision; commonly know as Sugarbeet Row. Temporary Construction Easement- Grantor grants a fifty(50) foot construction easement for the purpose of installing approximately eight hundred and thirty (830) feet of new eight (8) inch PVC sanitary pipe to be lined with cured in place pipe for the carriage of sewage and waste water and three(3)forty eight (48) inch manholes with covers. The scope of the temporary construction easement and location of the sewer line and manholes is more particularity detailed in Exhibit A, Town of Whitehall Sewer Easement, attached and incorporated by reference. This temporary easement is only in effect for the period of construction of the sewer main and associated infrastructure. All pipes shall be buried. Any damage to the ground resulting from work associated with the construction and installation of the sewer main shall be the responsibility of Grantee or its agents and shall be repaired immediately upon completion of the work. Any damage to Grantor's personal property or fixtures as a result of the construction and installation of the sewer main shall be the responsibility of Grantee or its agents and shall be repaired immediately upon completion of the work. I Non-exclusive Perpetual Public Utility Eaasement- Grantor further grants to Jefferson County a non-exclusive perpetual twenty (20) foot easement to access, maintain and operate the sewer main and associated infrastructure. The scope of the perpetual public utility easement and location of the sewer main is more particularity de ailed in Exhibit A,Town of Whitehall Sewer Easement, attached and incorporated by reference. Grantee shall have the right and the obligation to maintain the easement right-of- way or any portion thereof for the purpose of maintaining Grantee's sewer main and associated infrastructure. Provided however, this easement does not exclude Grantor or the general public from using the real property subject to this easement so long as such use does not cause or become detrimental to the use of Grantee.
