DEPT HEAD 2019 07-02 SUPT OF SCHOOLS Superintendent of Schools Meeting July 2, 2019 Present: Commissioners -Leonard Wortman, Bob Mullen, and Cory Kirsch and County Superintendent of Schools, Anika McCauley and County Attorney, Steve Haddon. Discussion was held regarding SB35. The purpose of the bill is to form a committee to facilitate information between schools and government agencies. Attached is a sample letter and resolution. The Commission will need to adopt a resolution appointing the committee. The resolution will be put on the August 13'agenda. ATTEST: ;..gerwv(11/ Bonnie Ramey Leonard Wortman, Chairman Clerk and Recorder Cory Kirsch, Commissioner Bob Mullen, Commissioner SB 35 COUNTY COMMISSION RESPONSIBILITIES AND SAMPLE LETTER MCA 52-2-211 County or Regional interdisciplinary child information and school safety teams existed prior to the enactment of SB 35. The purpose for forming the team is to ensure the timely exchange and sharing information that one or more team members may be able to use in serving a child in the course of their professions and occupations, including but not limited to abused or neglected children, delinquent youth, and youth in need of intervention, and of information relating to issues of school safety. SB 35 purposes: 1. Allows for regional teams to be formed which may be beneficial to our more rural areas where expertise in dealing with troubled youth; 2. Changes notification requirements previously required; 3. Grants the County Commission the authority over the appointment of the teams. Direction: 1. Determine if a regional team (not required) is in the best interest of your county and if so engage with neighboring county commissioners. If not,you still must form a county team. a. If you form a regional team it must be formalized by written agreement between the participating counties. 52-2-211 (2); 2. Request(with deadline) authorized designees from the following (sample letter attached): a. Youth Court b. County Attorney c. Department of Public Health and Human Services d. County Superintendent of Schools e. Sheriff f. Chief of Any Police Force g. Any Board of Trustees of a Public School District Operating within the Boundaries of the County h. Department of Corrections 3. Upon receipt of authorized designee names from any of the entities listed in 2, the Board of Commissioners shall formally appoint the county(or regional) Interdisciplinary Child Information and School Safety Team. a. Recommend the team appointments be placed in the official minutes and the documentation of the authorized designees retained in file. Timeline: 1. Request to agencies for designees sent out in June. Responses due back by July 1. 2. Appoint the Team in July. 3. Notify the agencies of the appointees. *If the team is going to create(optional-may be created)a written agreement to provide for the rules under which it will operate, the method by which information will be shared, distributed, and managed, and any other matters necessary to the purpose and functions of the team it must be submitted to the Office of Public Instruction by the County Superintendent of Schools by September 1. SAMPLE LETTER TO AGENCIES Date Letter needs to be sent to the following: Youth Court, County Attorney, Dept.of Health and Human Services, County Supt of Schools, Sheriff, Chief of any Police Force; Board of Trustees of any Public School District Operating within the Boundaries of the County; and the Department of Corrections RE: Interdisciplinary Child Information and School Safety Team (MCA 52-2-211) Dear The implementation of SB 35 from the 2019 session now requires that the county commissioners of each county ensure the formation of a county or regional interdisciplinary child information and school safety team. Your agency or organization is one of the several statutory named entities that may authorize a designee for forming the team by the commission. If your agency would like representation on the interdisciplinary team, please submit the name of your authorized representative by July 1, 2019. The commission will appoint the team utilizing the name submitted by your agency and the names submitted by the other eligible entities. Thank you for your prompt response. Respectfully, Sample Resolution (Optional) Resolution Ordering the Creation of County Interdisciplinary Child Information and School Safety Team Res. 2019- Whereas, section 52-2-211, section (1) MCA, states "county commissioners shall ensure the formation of an interdisciplinary child information and school safety team"; Whereas, section 52-2-211(1) further states that such team "includes representatives authorized by any of the following": youth court; county attorney, department of public health and human services, county superintendent of schools, sheriff, chief of any police force, any board of trustees of a public school district operating within the boundaries of the county and the department of corrections; Whereas, section 52-2-211 (2)further directs that team officials may also cooperate with officials from other counties to form a regional interdisciplinary child information and school safety team and are to be formalized by written agreement; Whereas,the interdisciplinary child information and school safety team will operate under the further guidance of 52-2-211(3),(4),(5),(6),(7) and (8); Whereas, 52-2-211(9) requires "The County Superintendent of Schools shall provide to the Office of Public Instruction a current copy of any written agreement under this section no later than September 1;" Therefore, Be It Resolved, by order of the County Commissioners, they hereby form the County Interdisciplinary Child Information and School Safety Team.
