1988 JULY LISA BAY CONSULTING CONTRACT THIS CONTRACT entered into on this ~3'day of Lid , 1988, by and between Jefferson County, hereinafter referred to as "County" and Lisa Bay Consulting, hereinafter referred to as "Consultant` WITNESSETH: All parties to this contract do mutually agree and certify as follows: I. Consultant will provide planning assistance pursuant to State law and the Jefferson County Subdivision Regulations, for proposed subdivisions located in Jefferson County, Montana, and other planning projects as directed by the Planning Board. II. The services to be provided by the Consultant will be in accordance with the following scope of work: A) Pre-application consultation with subdivision applicants; B) Review of preliminary plat and supplemental documents for completeness and suitability for Planning Board review; C) Staff report on subdivision including: 1. Site visit; 2. Discussions with officials and applicant, and interested public as appropriate; 3. Identification of problems; 4. Draft staff report, including conditions for -1- approval if appropriate; 5. Attendance at planning board meetings and public hearings pertinent to the subdivision; 6. Attendance at meetings with county commission to discuss the subdivision; D) Final plat review of documents and on-site inspection to assure compliance with preliminary plat approval and Jefferson County regulations; E) Other specific projects as directed by the Planning Board; F) Review certificates of survey for correctness, completeness and compliance with Montana law before such certificates are filed. Certificates shall be reviewed on a schedule to be specified by the Commission. III. The total amount of compensation due Consultant for planning assistance shall not exceed $10,000.00 as per the following fee schedule: Professional Personnel: Lisa Bay -- Hourly Billing Rate -- $25.00 Direct Expenses: Ground Transportation $.225/mile Typing $10/hour Copying $.12/copy Telephone (as needed) -2- IV. The County shall comply with the following procedures to assist the Consultant: A) Provide notification to the Consultant of subdivision applications within ten (10) days of scheduled Planning Board meetings; B) Direct planning or subdivision related questions to the Consultant; C) Provide copies of Planning Board and County Commission action to Consultant including minutes of meetings, informal communications and policy revisions (relating to subdivisions or planning projects). The County will provide said information within ten (10) working days of any action herein described; D) Provide clarification of County regulations and policies when requested by Consultant. V. Consultant will bill the County monthly, by a date specified by the Commission, for the previous month's work. Payment will be due within thirty (30) days thereafter. VI. This contract will extend from July 1, 1988 through June 30, 1989, unless terminated by the parties. The contract may be terminated by either party giving the other party written notice of termination within fifteen (15) days of the date of termination specifying the reasons therefore. In the event of termination, all finished or unfinished documents, data, studies -3- VII. All rights to the materials and reports generated under this and reports prepared by Consultant under this contract shall be retained by the County, Consultant shall be entitled to compensation as specified in paragraph III above for all work satisfactorily completed hereunder, contract shall be the exclusive property of the County, VIII. Both parties do mutually agree that this contract contains no inducements, promises or approval of subdivisions or planning projects, or statements made by either party hereof, or agent of either party thereto, which is not contained in this written contract.
