RES 1967 BOULDER-JEFFERSON PLANNING BOARD w RESOLUTION OF THE JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS ESTABLISHING A JOINT BOULDER - JEFFERSON COUNTY CITY - COUNTY PLANNING BOARD The following resolution was introduced by Albert Haab, Commis - ioner, was seconded by George Dawson, Commissioner, and passed by the Board of County Commissioners of Jefferson County, Montana. RESOLUTION WHEREAS, The Board of County Commissioners of Jefferson County, Montana does hereby elect to join with the City - County Planning Board duly created and established by the City of Boulder, Montana in City Ordinance No. 4 �, _ dated a a- A,'add.y : Q in accordance with the provisions of law; and WHEREAS, The Board of County Commissioners have found it desirable and necessary to undertake comprehensive planning studies for the county areas outside the jurisdictional area of said planning board for the purpose of qualifying rural communities for certain Federal assistance programs; and to have these studies encompassed in a Comp- rehensive Area Plan for water and sewer systems; and WHEREAS, the preparation of this Comprehensive Area Plan for water and sewer systems will, in addition to assisting the rural com- munities in Jefferson County to qualify for grant assistance from various governmental sources, do the following: 1. Develop an awareness on the part of the people of an area of their water and waste disposal problems. 2. Develop a desire on the part of the people of an area to solve problems or prevent problems in connection with water and waste disposal. Such desire or concern should lead to local community action to improve or install water and waste disposal facilities. 3. Assist local leaders to become knowledgeable of services that are avialable from governmental and private sources to assist them. 4. Determine the best and /or alternate sources of water and methods of waste disposal, and the advantages and disadvantages of each. 5. Prevent duplication of facilities. 6. Coordinate use of common facilities, such as water supplies or waste treatment plants. 7. Provide information for properly designing facilities. AND, WHEREAS, the Board of County Commissioners under authority of the 1965 amendment of Title 11, Chapter 38, RCM 1947, and speci- -1- .le fically Section 11- 3830.1, may request the City - County Planning Board to conduct specific planning projects within the county and outside the jurisdictional area of City - County Planning Board; and NOW, THEREFORE, the Board of County Commissioners desires to have the City - County Planning Board undertake the preparation of a Comprehensive Area Plan for the orderly development of water and sewer systems in the rural communities of Jefferson County; and WHEREAS, it is expressly desired that this Comprehensive Area Plan will encompass the rural areas of Jefferson County, Montana, with specific reference to the unincorporated communities of Basin, Clancy, Alhambra and the incorporated towns of Boulder and Whitehall; NOW, THEREFORE, BE IT RESOLVED that the Board of County Com- missioners hereby request the Boulder - Jefferson City - County Planning Board to undertake the preparation of a Com- prehensive Area Plan for the orderly development If water and sewer systems in the rural communities of Jefferson County outside the jurisdictional area of said City - County Planning Board; and WHEREAS, in furtherance of such decision for the need of the preparation of a Comprehensive Area Plan, it is hereby decreed that the City- County Planning Board be authorized to execute all necessary, agreements, reports, and other instruments in connection with the receiving of a grant as may be required by the Farmers Home Adminis- tration; and said Comprehensive Area Plan for water and sewer systems is to be prepared in accordance with the guides furnished by the Farmers Home Administration, and the covenants of the Grant Agreement; AND, it is further authorized that the City - County Planning Board is authorized to accept, receive, and expend funds in the form of a grant to be received from the United States of America, acting through the Farmers Home Administration, United States Department of Agriculture; and NOW, THEREFORE, BE IT FURTHER AESOLVED that the Board of County Commissioners of Jefferson County, ontana, in consideration of the foregoing, and in accordance with the provisions of the law as set forth above, does hereby ratify and approve the formation of the City - County Planning Board, the request for a Comprehensive Area Plan, execution of documents in connection therewith, and acceptance and payment of such grant funds and services from the Federal Government by the Boulder - Jefferson City - County Planning Board, and directs said planning board to accept grant funds and deposit the same with the city or county in a special non - reverting planning board fund to be available for expenditure by the planning board for the purpose designated by the Farmers Home Administration, that withdrawals or disbursements of said funds shall be subject to the approval of the County Supervisor or other designated representative of the Farmers Home Administration and evidenced by warrants or vouchers in the manner required by law. AND, IT IS FURTHER RESOLVED that the Chairman of the Board of County Commissioners is hereby duly authorized by said Board of County Commissioners to join with the designated official of the City - County Planning Board in the execution of the "Grant Agreement" which agree- ment is the official request for planning for development of water and -2- sewer systems in the rural areas of Jefferson County; and to execute such other forms, documents, agreements or reports in connection therewith.
