RESOLUTION 34 -89 WHEREAS, on September 20, 1985, Certificate of Survey #134047 was filed with the Jefferson County Clerk and Recorder, which filed the sale and division of a 1.464 acre subparcel from Lyle G. Fox's 8.746 acre parcel located in the NE 1/4 of Section 25, Township 4 North, Range 7 West, Jefferson County; and WHEREAS, Lyle G. Fox claimed an agricultural exemption, from the review requirements of the Montana Subdivision Act, for the �..� - transaction and for the remaining 7.282 acres and subjected the same to a covenant (revocable only with the consent of the Board of County Commissioners) which restricted the use of the property to agricultural uses only; and WHEREAS, Lyle G. Fox is now requesting that the agricultural covenant be removed from the 7.282 acres; and WHEREAS, on July 18, 1989 the Jefferson County Board of Commissioners, by motion, approved removing the agricultural covenant, contingent upon removal of the sanitary restrictions, on the 7.282 acres located in the NE 1/4 of Section 25, Township 4 North, Range 7 West, Certificate of Survey #134047; and WHEREAS, on October 19, 1989 sanitary restrictions were lifted on the above mentioned property by the Montana Department of Health and Environmental Sciences. NOW THEREFORE BE IT RESOLVED by the Jefferson County Board of Commissioners that the agricultural covenant is revoked on Lyle G. Fox's 7.282 acres located in the NE 1/4 of Section 25, Township 4 North, Range 7 West, shown on Certificate of Survey #134047, Jef$e`rson County. yr r .Dated this .� aL y of 1989.
