RES 1988-20 CLANCY QUICK RESPONSE UNIT RESOLUTION NO. 20 -88 WHEREAS, there is a need for emergency medical services for northern Jefferson County, Montana, with such services to include the provisions of initial emergency medical care to victims of injury or sudden illness, and the provision of assistance to ambulance personnel in rendering emergency medical care; and, WHEREAS, Jefferson County for several years has been providing funds to an organization known as the "Clancy Quick Response Unit" for the operation of such a program and the provision of the above- described services; and, WHEREAS, it is therefore necessary and appropriate that formal recognition be given by Jefferson County to said program, and a formal structure and guidelines shall be established for the operation of said program and the provision of such services, in order that Jefferson County and all involved persons may be properly insured against liability; and, NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Jefferson County, State of Montana, as follows: 1. That the provision of emergency medical services, including medical care for victims of injury or sudden illness and assistance for ambulance personnel in rendering additional emergency medical care, is declared to be a program of Jefferson County, Montana; provided that the foregoing does not evidence any present intention of Jefferson County to operate an ambulance service. 1 2. That said program shall be conducted, and said emergency medical services provided, by the Clancy Quick Response Unit, Inc., which shall be a nonprofit corporation incorporated under the Montana Nonprofit Corporation Act, with members comprised of volunteers from the community; provided that, for purposes of general supervision, the Jefferson County Sheriff shall at all times be a voting member of the corporation. 3. That the Clancy Quick Response Unit, Inc., shall operate said program, and provide said services, at the request of Jefferson County, Montana, and all emergency responses shall be coordinated by Jefferson County Sheriff's Office. 4. That the Clancy Quick Response Unit, Inc., shall provide said services within Jefferson County in cooperation with a coordinated dispatch procedure initiated by the Jefferson County Sheriff's Office. 5. That the Clancy Quick Response Unit, Inc., shall respond, to the location of medical emergencies, injury or illness, upon being first dispatched by the Jefferson County Sheriff's Office; provided, however, that any qualified member of the Clancy Quick Response Unit, who inadvertently happens upon or encounters a medical emergency, without first being dispatched, may function as if she /he has been dispatched until the Sheriff's Office can be notified. 6. That the Clancy Quick Response Unit, Inc., shall provide any and all such services only with properly trained 2 and /or certified personnel, who are subject to appropriate supervision, in accordance with all applicable laws, rules and regulations of the State of Montana. 7. That, in the event the Clancy Quick R e s p o n s e Unit, Inc., wishes to obtain funding from Jefferson County for any of its activities, it shall prepare an itemized and detailed budget and submit the same, along with its request for funding, to this Board of County Commissioners at such times, and in such form, as required by the general County budget process. 8. That, only for purposes of the Montana State Tort Claims Act and liability thereunder, as said Act applies to local government, and only for purposes of the policies of liability insurance insuring Jefferson County under said act, the Clancy Quick Response Unit, Inc., and its members are declared to be agents of said County and shall retain such status as long as they operate in strict accordance with the provisions of this Resolution provided that; a. By Laws be completed and submitted to the Board of Commissioners by the first Commission meeting in March 1989. b. Qualifications for participants are to be available for Commission review.
