RES 1988-13 FIRE HAZARD RESOLUTION 13 -88 WHEREAS, the Department of State Lands, Forestry Division has issued the following proclamation: This Proclamation is issued in compliance with State of Montana Fire Regulation Number 9 (Sub - Chapter 1, 26.6.219 Administrative Rules of Montana) promulgated under authority of Section 76 -13 -109 Montana Code Annotated which restricts certain activities on forest lands (as defined under Section 76- 13- 102(8) Montana Code Annotated). The Following areas have been designated as areas of high forest fire hazard and are subject to certain restrictions which include: 1. The banning of campfires, without a permit, except at a developed, designated recreation site or campground. 2. The banning of smoking except within an enclosed vehicle or building; at an improved place of habitation; at a developed, designated recreation site or campground; or while stopped in an area at least three feet in diameter that is cleared of all flammable material. This proclamation is in effect for all state and private forested lands, under the protection of the Department of State Lands, lying within the boundaries of Cascade, Broadwater, Lewis and Clark and Jefferson Counties. This proclamation is effective as of 12:01 a.m. Sunday, July 24, 1988 and will remain in effect until rescinded by the Administrator, Division of Forestry, Montana Department of State Lands. In the event such request is refused, the Administrator may issue a written order directing compliance. Failure to comply with such order is a misdemeanor punishable by a fine of not more than $500.00 or imprisonment in a county jail for not more than 6 months or both (76 -13 -122 Montana Code Annotated), WHEREAS, current fire conditions in Montana and Jefferson County are extremely incendiary, and WHEREAS, Resolution 12 -88 established the fire season as July 25, 1988 through December 31, 1988, and WHEREAS, immediate adoption of this resolution as an emergency measure to protect life and propety is necessitated by the current fire conditions in Montana and Jefferson county, requiring adoption of this resolution as an emergency resolution pursuant to Title 7, Chapter 5, Part 22, MCA, r NOW THEREFORE BE IT RESOLVED, that the Board of County Commissioners adopts the proclamation issued in compliance with State of Montana Fire Regulation number 9 (Sub - Chapter 1, 26.6.219 Administrative Rules of Montana) promulgated under authority of Section 76--13 -109 Montana Code Annotated which restricts certain activities on Forest Land (as defined under Section 76 -13-102 (8) MCA. BE IT FURTHER RESOLVED that this resolution hereby specifically supersedes all prior resolutions or operating directives in conflict herewith and, as an emergency measure, becomes effective this date.
