RES 1987-14 DISTRICT COURT RESOLUTION NO. 14 -87 WHEREAS, there are claims against the district court fund for fiscal year 1987 which exceed the total appropriation by the sum of $14,044.00, and, WHEREAS, this situation was created by excessive expend- itures for litigation of criminal cases during the past fiscal year which could not have been contemplated at the time of the adoption of the final budgets for fiscal year 1987, and WHEREAS, there is adequate revenue, because of state district court expense reimbursement, to pay the claims but insufficient appropriation to allow the expenditure, and WHEREAS, Section 7 -6 -2341, MCA, provides a statutory method by which the board of county commissioners may, by unanimous resolution, pay such claims, and WHEREAS, it appears to the board of county commissioners that the provisions of this statute apply to the problem occas- ioned by this deficit in appropriation, NOW, THEREFORE, BE IT RESOLVED by the board of county commissioners that the clerk and recorder is directed, pursuant to Section 7 -6 -2341, MCA, to pay those remaining claims for fiscal year 1987 now pending against the district court fund in the amount of $14,140.51 , the county being mandated to pay such expenditures by law, thus allowing utilization of the above - referenced section. BE IT FURTHER RESOLVED that the situation presented by the lack of adequate budget authority constitutes an emergency situation as contemplated by Section 7 -5 -2202, in that failure to pay the claims in a timely manner subjects the county to possible litigation for non - payment and therefore, this resol- ution is hereby enacted as an emergency resolution, effective immediately.
