RES 1986-05 EXPERT WITNESS SERVICES RESOLUTION ESTABLISHING JOINT FUNDING OF EXPENSES FOR PURPOSES OF RETAINING EXPERT WITNESS SERVICES WHEREAS, the State of Montana, the Department of Revenue, and three Montana Counties have been named as defendants in the Lawsuit brought by Pacific Power and Light Company, et al over the issue of the application of provisions of state law for the assessment of beneficial use taxes, and WHEREAS, the Plaintiffs' action bears on the issue of the transmission of electrical power over the portion of the line from Townsend to Garrison substation, and may impact the remaind- er of the Bonneville Power Line to the Idaho border, and WHEREAS, this action directly and indirectly affects the .Montana - Counties of Broadwater, Jefferson, Granite, Powell, Missoula and Mineral, and WHEREAS, the Department of Revenue, and their legal counsel, is defending this case, and WHEREAS, there is an identified need for an expert witness to attest to the "use" provisions associated with high voltage transmission line systems, and WHEREAS, the above mentioned counties have determined that participation in the litigation is in the interest of the public in each of said counties, and WHEREAS, the Departent of Revenue has stated to the affected counties that it is without funds to hire such expert and that retention of this necessary expert depends entirely on payment of his fees by the counties; NOW THEREFORE BE IT RESOLVED that said Counties, having agreed in a public meeting to bear the costs associated with con- tracting for an expert witness, do hereby agree to a pro - ratable assessment, based upon actual costs, upon each of the aforemen- tioned six counties in an amount estimated by the Department of Revenue to be approximately $2,800.00 plus expenses. BE IT FURTHER RESOLVED, that the Montana Association of Counties, will act as paying agent for the six counties, and will assess and collect from each equally an amount sufficient to meet the costs of the expert witness to be identified and retained throug MACo and the Department of Revenue.
