RES 1986-03 EXCEED MILL LEVY w Y RESOLUTION NO. WHEREAS, Section 7 -6 -2501, MCA, in effect provides a maximum mill levy limitation of 27 mills for the county general fund, and WHEREAS, Section 7 -14 -2501, MCA, provides a maximum mall levy limitation of 18 mills for the county road fund, and WHEREAS, the Board of County Commissioners has determined that, due to the amount of taxable valuation in Jefferson County which is under protest, imposition of these maximum mill levies for the general fund and the road fund will provide insufficient levels of funding for the services required of these funds during the next two fiscal years, and WHEREAS, Section 7 -6 -2531, MCA, allows the Board of County Commissioners to exceed these maximum mill levies for the support of county government services under certain stated conditions and upon a vote of approval by the majority of electors voting on the issue, NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners hereby proposes to exceed, upon receipt of the necessary votes, the current statutory milt levy maximums as follows: GENERAL FUND (a) The specific purpose for which the additional money will be used is to maintain the current level of services that are provided to the county through the general fund; (b) The specific amount to be raised is the sum of One Hundred Twenty -two Thousand Seven Hundred Fifteen Dollars ($122,715.00); (c) The approximate number of additional mills required is 7.05 mills; (d) The specific mill levy limitation to be exceeded is 27 mills, for a total of 34.05 mills. ROAD FUND (a) The specific purpose for which the additional money will be used is to maintain the current level of services that are provided to the county through the road fund; (b) The specific amount to be raised is the sum of Eighty -- one Thousand Eight Hundred Ten Dollars ($81,810.00); r ` (c) The approximate number of additional mills required is 5.16 mills; (d) The specific mill levy limitation to be exceeded is 18 mills, for a total of 23.16 mills. BE IT FURTHER RESOLVED that, as provided by Section 7 -6 -2531 MCA, the question of whether to exceed the mill levy maximums as outlined above shall be submitted to the qualified electors of Jefferson County at the next regular primary election, to be held on June 3, 1986. If a majority of those voting on the question are in favor of the additional levies, the Board of County Commissioners is statutorily authorized to exceed the statutory mill levy limits in the amounts specified above for a period not to exceed two years. BE IT FURTHER RESOLVED that, since the ballot language for the vote herein described must be prepared and available for printing not later than this date, this measure is hereby declared to be an emergency measure pursuant to Section 7 -5 -2202, MCA, and, as such, effective immediately so that the ballot language may be printed, thereby allowing the issue to appear on the primary election ballot.
