Box H Boulder, Montana 5963 406/225 -421 1 June 21, 1985 Mrs. Joanne McFarlane Jefferson County Clerk & Recorder Jefferson County Courthouse Boulder, Mt. 59632 RE: County Extension Agent Budget Dear Joanne: I have reviewed the resolution passed by Jefferson County Commissioners dated February 19, 1985, regarding the allocation of PILT money. It is my opinion that the $2500 allocation to the County Extension Agent Budget must necessarily go to the personal services category of such County Extension Agent Budget. The resolution states that the $2500 allocation is for the purpose of hiring and paying for a half -time homemaker position in such department. Since employee wages can only be paid from personal services money, I believe it is sufficiently clear that the $2500 allocation must automatically go to the personal services category of the County Extension Agent Budget. It is my opinion that a further resolution to clarify this point is unnecessary. If you have any questions regarding this opinion, please feel free to contact me. WHEREAS, Section 7 -6 -2218, MCA, provides authority for the board of county commissioners to appropriate money received from the federal government during a given fiscal year for which no prior appropriation was made, and, WHEREAS, Jefferson County has received $15,334.00 in P.I.L.T. funds in excess of that which was anticipated in the fiscal year 1985 budget, and, WHEREAS, a public hearing was held on January 2, 1985 for the purpose of receiving public comment relative to the allocation of such P.I.L.T. money, NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners of Jefferson County hereby allocates the unanticipated P.I.L.T. moneys as follows: 1. The sum of $2,500.00 to the County Exten- sion Agent budget for the purpose of funding a half -time homemaker position to be shared with Madison County; 2. The sum of $2,136.00 to the Boyd Andrews Center for Alcohol Rehabilitation Services; 3. The sum of $2,500.00 to the District. Court for the support of the Attention Home - - fvr- childrerx r Leasers- - -- and Clark County; 4. The sum of $8,198.00 of such P.I.L.T. funds shall remain unallocated. The effective date of this appropriation shall be thirty (30) days from the date of this Resolution. DATED this K day of February, 1985.
