RES 1982-04 SUBDIVISION COMPLIANCE RESOLUTION NO. J WHEREAS, considerable unavoidable problems have developed as a consequence of the failure to developers to comply with the Jefferson County Montana Subdivision Regulations and, WHEREAS, such non - compliance creates continuing problems which must be rectified by planning boards and county commissioners who have not been responsible for said problems; NOW THEREFORE, before any additional subdivision developments will be accepted by the Jefferson County Commissioners there will be full compliance with the Jefferson County, Montana, Subdivision Regulations, not exclusive of, but with particular emphasis upon compliance with: 1.) 18. Final Plat Fill-n . Within ten days of the approval of the final plat or minor subdivision plat, the governing body shall file the cloth - backed copy and the reproducible copy of the approved final plat with the county clerk and recorder. After filing, the plats may not be altered in any manner. The county clerk and recorder shall refuse to accept any plat for record that fails to have approval in proper form and shall file approved plats only if they are accompanied by the following items: \,g.) Copies of final plans, profiles, grades and specifications for improvements, including a complete grading and drainage plan, with the certification of a registered professional engineer that all required improvements which have been installed are in conformance with the attached plans.- 2.) DESIGN AND IMPROVEMENT STANDARDS Streets and Roads (17) Private roads. All platted private roads shall have a minimum of 60 feet right -of -way and grades shall not exceed maximums set for the dedi- cated roadways. This is to facilitate the event- ual dedication of these roads for public use. Non - dedicated roads shall be maintained by a home owners association. Each plat and document of conveyance shall contain the following statement: "The purchaser and /or owner of this lot or parcel understands and agrees that private road construction, maintenance, and snow removal shall be the obligation of the owner or Home Owners Association and that Jefferson County is in no way obligated until the roads are brought up to standards and accepted by the county." 3.) There will be full and detailed compliance with: MINIMUM DESIGN SPECIFICATIONS - RURAL as set out on pages 27 and 28 of the Jefferson County, Montana, Subdivision Regulations. APPENDIX B Jefferson County, Montana, Sub- division Regulations, D. INSPECTION AND CERTIFICATION 1. Upon completion-o- required improvements, the subdivider shall file with the governing body a statement certifying that: (a) All required improvements are complete; (b) These improvements are in compliance with the minimum standards specified by the governing body for their construction; (c) The subdivider knows of no defects in those improvements; (d) These improvements are free and clear of any encumbrance or liens; (e) A schedule of actual construction costs has been filed with the governing body; and (f) All applicable fees and surcharges have been paid. 2. The subdivider shall also file with the governing body copies of final plans, profiles, grades and specifications for improvements with the certification of the registered professional engineer responsible for their preparation that all required improvements have been installed in conformance with these specifications. (Certification of Completion Form to be used is as set out on page 68 of the Jefferson County, Montana, Subdivision Regulations.) DATED this 2nd day of March 1982.
