RES 1981-39 SWEET LAWSUIT RESOLUTION NO. WHEREAS, Norman Sweet has filed suit in the District Court of the Fifth Judicial District of the State of Montana, In and For the County of Jefferson, against Jefferson County, Harold Demers, Forrest L. Shewmaker and John Doe Dawson as defendants, the same being Cause Number 6839, in which suit Sweet seeks money damages from the defendants for their alleged failure to protect him from or prevent the action of one George Gammel who injured Sweet by planting a pipe bomb in Sweet's vehicle; and - Demers, Shewmaker and Dawson, whose conduct gave rise to this suit, arose out of the course and scope of such persons' employment with Jefferson County, and the claim is not based upon an intentional tort or felonious act of the said persons, but instead, on their alleged negligence or failure to perform duties allegedly owed to Sweet; and WHEREAS, the County Commission of Jefferson County is generally aware of the findings made in criminal investigations conducted by authorities in the City of Helena and Lewis and Clark County, and is further aware that Jeff Sweet, Della Sweet and George Gammel were all convicted of criminal offenses with respect to the bombing incident in which Norman Sweet was injured. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Jefferson County; 1. That pursuant to Section 2- 9- 305(3), M.C.A., Jefferson County acknowledges that the conduct upon which the claim of Norman Sweet is brought arose out of the course and scope of the employment of Harold Demers, John Doe Dawson (who the Board is informed may be either Tom Dawson or Drew Dawson), and Forrest Shewmaker.
