RES 1973-01 SOLID WASTE DISTRICT ALLEN LeMIEUX. rho*e 225 -3322 County Attorney Jefferson County BOULDER, MONTANA 5868 1973 Mayor of Boulder, Montana Mayor of Whitehall, Montana Re: Countywide refusal disposal district Gentlemen: I am enclosing with this letter to each of you a coi;py of the resolution of intention to form a county -wide refusal disposal district which was passed by the Jefferson County Commissioners on March 7, 1973. With the passing of this resolution, the question of whether or not your city will become a member of the county -wide refuse - disposal district must be decided by your city council. If you wish to become a member of this district, the city council shall by resolution concur in the resolution of the commissioners and send a copy of this resolution of concurrence to the board of commissioners. If your city does not wish to join in this district, the failure of '.the city council to concur in the resolution of the commi s..a1oner,&. means.. that the county commissioners will have no authority to include your city within the district, but that they may continue to develop the county -wide district with the exception of the territory included within the limits of your city. If by resolution you concur in the resolution of the county commissioners, the matter will be advertised for public hearing at which time citizens will have an opportunity to file written protests, etc. I would urge each of you to have this matter presented as soon as possible to the city council for their decision. Sincerely yours, ,.ter ALM /s n eMl Enc. f + r ' BEFORE THE BOARD OF COUNTY COMMISSIONERS AND FOR JEFFERSON COUNTY, MONTANA DISTRICT ENCOMP SING L 0 - v , IT APPEARING to the members of the Board of County Commissioner., for Jefferson County Montana, that it has now become necessary that a refusal disposal district be created for the purpose of collection and/or disposal of refuse, IT IS HEREBY RESOLVED that the undersigned board intends to create a refusal disposal district under the provisions of chapter 60 of Title 69, Revised Codes of Montana for 1947, as amended. I -The proposed name of such district is JEFFERSON COUNTY REFUSE DISPOSAL DISTRICT. 2. The necessity for the proposed district is created by the large quantity of refuse which is presently being disposed of in violation of state refuse disposal and pollution standards, the increasing population in Jefferson County, Montana, the difficulty in obtaining refuse disposal areas which are acceptable under the provisions of state pollution control laws and regulations, and the need for the organized and efficient collection and disposal of refuse within Jefferson County, Montana, for the prevention of the spread of disease, air pollution and water pollution. 3. The boundaries of the Jefferson County Refuse Disposal District shall be the same as the statutory boundaries established for Jefferson County, Montana. The collection service to be pro- vided shall be the pickup of all refuse as defined in section 69- 6902, _.. RCM 1947, as amended, and its disposal under the provisions of applicable state laws and regulations. 4. The annual estimated cost of providin the refuse collection and disposal service within said district is DATED this 7th day of Rttq"�'r, 1973.
