RES 1972-03 TEMPORARY INTERIM TEMPORARY INTERIM ZONING RESOLUTION NO. A RESOLUTION ENTITLED: "A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF JEFFERSON ADOPTING A TEMPORARY INTERIM ZONING REGULATION PURSUANT TO THE PROVISIONS OF SECTION 16 -4711, R.C.M., 1947." WHEREAS, this Board of County Commiss Toners intends to hold a hearing -fcr._ the purpose of considering a master plan and zoning regulations pursuant to Chapter 47, Title 16, of the Laws of Montana, 1963, and WHEREAS, the County Planning Board of the County of Jefferson, Montana, has recommended that an interim zoning regulation of the type and covering the area as hereinafter described be adopted by this Board of County Commissioners; and WHEREAS, it is necessary in order to promote the public health, safety, morals and general welfare of the people of the county that a permanent development pattern for the physical and economic development of the area hereinafter described be adopted; and WHEREAS, it is necessary as an emergency measure that an interim zoning regulation of the type hereinafter described covering said area be adopted by this Board of County Commissioners pending the adoption of a permanent zoning regulation or said area will be developed physically and economically in a manner contrary to the health, safety and general welfare of the people of the county and of the area involved before a permanent zoning regulation can be adopted as aforesaid; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Jefferson, Montana, that: 1. The temporary interim zoning regulation marked Exhibit "A" attached hereto and made a part hereof, is hereby adopted effective immediately pursuant to Section 16 -4711, R.C.P., 1947, and shall continue for a period of one year from the date hereof. 2. The area affected and subject to the said temporary interim zoning regulation is described as follows: Jefferson County School District No. 21 in its entirety. ♦ r4 i r ! f. k ATTACHMENT "A" DISTRICT REGULATIONS Intent - The intent of this district is primarily to provide land for agriculture and for the developmental blend of one - family residential living units. Each lot shall not have more than one family unit. It is the intent of this district that there may be a business district and that it will be to the discretion of the county planning board as to its location. There shall be no new feed lots in this district. A feed lot as used here means the confined feeding or fattening of 50 or more cattle, swine, sheep or horses for commercial marketing purposes. Wintering and dairying operations are not included. r A feed lot that has been empty for five consecutive years is no longer considered a feed lot. Permitted Uses 1. Conventional detached single - family dwellings. 2. Modular detached single- family dwellings placed on permanent foundations. Modular as used here applies more to size and general shape than to the degree s . of either finish or completeness. Modular dwelling defined: A detached one - family dwelling with all of the following characteristics: a. Designed for long -term occupancy and containing sleeping accommodations, a flush toilet, a tub or shower bath, and kitchen facilities, with plumbing and electrical connections provided for outside systems. b. That the dwelling unit is eligible for long -term amortized mortgage financing. ,3. Public and private institutions and uses. 4. Assessory Uses - Those uses of land or a subordinate building or portion of a main building; such use being secondary to or incidental to principal use or structure. 5. Temporary building for and during construction. -2- � K Minimum Lot Area - Each residential lot shall not be less than five (5) acres. Each residential lot shall not have more than one family unit. In the case where individual on -lot water and /or septic tank sewer is provided, the minimum lot area shall conform to the Montana State Department of Health and Environmental Sciences' requirements concerning said systems. Bulk Requirements 1. Front Yard - Every lot shall have a front yard extending not less than 20 feet. 2. Side Yards - Every lot shall have two side yards extending not less than 10 feet. 3. Rear Yard - Every lot shall have a rear yard extending not less than 25 feet. 4. Height - No residential building shall be higher than 24 feet.
